Refugee Case: Big win for AR LAW Service. A Shia woman from Pakistan: an Hazara.

Before coming to AR LAW Services, the client had gone to many law firms and refugee societies only to be told “no chance” you may as well go home to Pakistan.

Her claim had been rejected by the department of immigration and she faced “deportation” from Australia given the Australia Government did not regard her and her dependent young child to be a refugee.

However AR LAW Services was able to show that the decision by the Minister was incorrect at law

For deep within the legislation and supported by an ancient vain of jurisprudence (case law), AR LAW Services was able to clarify the meaning of the law so that the applicant was found to indeed be a woman at risk and thereby deemed to be a refugee.

Who is a refugee?

According to the United Nations Convention and Protocol relating to the Status of Refugees (also called the Refugee Convention), a refugee is someone who is outside their own country and cannot return due to a well-founded fear of persecution because of their:

  • race
  • religion
  • nationality
  • membership of a particular social group or
  • political opinion

So both the applicant and her child are now free to remain in Australia and live their lives free of persecution.
