Over the last 25 years I have been running AAT appeals for many clients and one of the most difficult cases are those when you have to fight a ghost.  Or that is what it feels like.

The difficulty and occasionally unfair procedure – as happened in a case I ran recently – is when the Minister introduces evidence under a certificate.  That is anonymous adverse or damaging evidence.

The true danger with this sort of evidence – as was the case here – is it is prone to exploitation.  False witness is a common occurrence.  I don’t practice Family law but I do see many intervention orders and safety and it seems a common tactic in failed partner visa matters.  (Jilted lovers seem to have cornered the market for statements under seal)

But as difficult as these cases are, as this recent case attests to, they can be won!
