PIC 4020 – Big win – AAT appeal – Waiver case – bogus documents – false and misleading documents: Fake passports: Dodgy migration agents.

I won a case last week – a great case: full of allegations of lies and deception – bogus documents and fake identity.  It was a so called PIC (public interest criteria) 4020 case at the AAT.

(There was also a sub plot of domestic abuse and pulling all the strings a dodgy migration agent…)

For more than 25 years I have been winning complex visa cases –  particularly at the AAT and Federal Circuit and Federal Courts.

This case the client was removed from Australia for a visa breach.  The client got in contact with a migration agent who promised she could return to Australia straight away without dealing with the return ban period.

Following a name change for the applicant, this particular migration agent filed a student visa application with a fictious partner – it was successful.

On reaching Australia the client fell in love with an Australian citizen and a partner visa was applied for.

Unfortunately the dodgy student visa work done by the dodgy migration agent caught up with the client after the partner visa was filed.

Even with all of this “baggage” I was able to convince the member to us her discretion and waive the PIC 4020 requirement and remit the matter back to the department to be reconsidered.
