				<content:encoded><![CDATA[<p>In his recent interview with SBS, the Minister of Immigration and Multicultural Affairs, Minister David Coleman, advised that regional visas will be given a priority under his portfolio.  It is also worthwhile noting that immigration portfolio no longer falls under Home Affairs Ministry.</p>
<p>The Minister raised several consequences which are to be expected:</p>
<ul>
<li><strong>Realignment of allocated places for regional visas such as subclass 489 regional (provisional visas)</strong>.  This visa allows skilled workers to live and work in regional or low-population growth metropolitan areas of Australia for up to four years.  This visa also offers a pathway of permanent residence for migrants who have demonstrated commitment to living in a regional area. Recent invitation round published on Home Affairs website for August 2018 indicated that a mere 10 invitations were issued for this subclass.  This is a sharp drop compared to last years’ figures where approximately 250 invitations were issued for the same month</li>
</ul>
<ul>
<li><strong>Greater focus on RSMS program</strong>.  Currently this visa allows employers to nominate foreign workers for permanent residence to fill genuine vacancies in their business. Participation in the RSMS is restricted to businesses actively and lawfully operating in regional Australia.  Regional Australia has the meaning as outlined in the relevant legislative instrument and does not include major cities Sydney, Melbourne, Brisbane or Perth.  The Regional Sponsored Migration Scheme (RSMS) is specifically designed to assist regional employers nominate skilled migrants to fill a full-time vacancy (available for at least two years) when there is a genuine need for a paid employee in a business located in regional Australia. The RSMS category is not points tested and applicants may be overseas or already in Australia on a temporary visa. RSMS covers all areas of Australia except Brisbane, Gold Coast, Newcastle, Sydney, Wollongong and Melbourne</li>
</ul>
<ul>
<li><strong>Expansion of Regional Occupation List (ROL).  </strong>This list designed to include occupations that are in need in regional areas.  ROL is updated on a regular basis on advice by the Department Jobs and Small Businesses.  Migrants can access ROL if their occupation is located in a regional area (for example, direct access to subclass 482 and 186 visas).  The Australian Department of Jobs and Small Business is a department of the Government of Australia charged with the responsibility for employment, job services and the labour market, workplace relations, small business, and deregulation</li>
</ul>
<ul>
<li><strong>Greater focus on Labour Agreements.  </strong>Labour agreements enable approved businesses to sponsor skilled overseas workers when there is a demonstrated need that cannot be met in the Australian labour market and standard temporary or permanent visa programs are not available. Labour agreements are developed between the Australian Government (represented by the Department) and employers. They are generally in effect for five years and provide for visas and offer a pathway to permanent residence.  The government has been vocal on use of Labour Agreements as a solution to skills shortages in regional areas.  There are also industry specific labour agreements including dairy, fishing, meat, pork and restaurant</li>

				<content:encoded><![CDATA[<p>The Department of Home Affairs has kindly informed AR LAW Services of the following updates on the Australian visa program:</p>
<div id="sub-heading-0" class="content-block">
<p>A six-monthly review cycle of the occupation lists was established by the Australian Government in April 2017 to ensure that the skilled occupations lists appropriately reflect genuine needs in the Australian labour market, and align with the Government&#8217;s policy that Australian workers have priority.</p>
<p>Updates to the occupation lists for temporary and permanent skilled visas will come into effect on or about 17 January 2018. This update is based on the review conducted by the Department of Jobs and Small Business (DJSB) in late 2017, which is now complete. This review was informed by labour market modelling and analysis, and feedback from employer and employee groups, and other government agencies.</p>
<p>The Department of Home Affairs has recently re-structured its <a href="https://www.homeaffairs.gov.au/trav/work/work/Skills-assessment-and-assessing-authorities/skilled-occupations-lists">occupation list web page</a> to make it easier for clients to determine which occupations are eligible for particular skilled visa programs. This page will be updated again once the new skilled occupation lists come into in effect to reflect the changes. A summary of the changes will, however, be made available prior to this date.</p>
<p><strong>Note: </strong></p>
<div>
<ul>
<li>The new occupation list instruments, which come into effect, will <strong>not</strong> be applied to pipeline applications. This includes the new instrument that relates to the Temporary Work (Skilled) visa (subclass 457) program.</li>
<li>The next occupation list instruments will be published in March 2018 for the Employer Nomination Scheme visa (subclass 186), the Regional Skilled Migration Scheme (RSMS) visa (subclass 187) and the Temporary Skill Shortage (TSS) visa consistent with the broader legislative changes being implemented at this time.</li>
<li>To align the Training (subclass 407) visa with other visa programs, a number of occupations which were previously not eligible for this visa will be available when the instrument comes into effect.</li>
</ul>

				<content:encoded><![CDATA[<p>The subclass 485 Temporary Graduate Visa is for students who are completing their studies in Australia.</p>
<p>Once upon a time the SC485 had only one stream.</p>
<p>Any student completing two years of studies (92 weeks) that will award a degree, diploma or trade qualification within the last six months was eligible for an eighteen month visa. The visa applicant had to nominate an occupation on the relevant occupation list and then obtain a positive skills assessment for the SC485 visa purpose.</p>
<p>In 2013 March, the government introduced a two stream SC 485 visa which comprises of:</p>
<ol>
<li>Graduate Work Stream; and</li>
<li>Post-Study Work Stream</li>
</ol>
<p><strong>GRADUATE WORK STREAM</strong></p>
<p>This stream is parallel with the initially introduced SC485 visa.</p>
<p><strong>POST-STUDY WORK STREAM</strong></p>
<p>The important differences in this stream is that the applicant:</p>
<ol>
<li>Is required to have applied for their first student visa after 5 November, 2011;</li>
<li>Does not have to nominate an occupation;</li>
<li>Does not have to obtain a skills assessment from an assessment body; and</li>
<li>Leads to the grant of a SC485 visa that will either have two years (for bachelor or Master by course work qualification), three years (Master qualification in research) or four years (Doctoral qualification) depending on the studies completed in Australia;</li>
<li>In addition to satisfying the two year Australian study requirement, the applicant needs to have completed one of the following qualifications:
<ol>
<li>Bachelor Degree;</li>
<li>Bachelor (Honors) Degree;</li>
<li>Masters by Coursework Degree;</li>
<li>Masters (Extended) Degree and/or;</li>
<li>Doctoral Degree.</li>
</ol>
</li>
</ol>
<p>It is important that the applicant’s qualification must have been completed as a result of undertaking study at Australian Qualification Framework (AQF) level 7 or above.</p>
