is a short stay visa for people occupational training or professional development in Australia.

Visa Criteria

All applicants must show that they:

• Have turned 18 (or can demonstrate exceptional circumstances)
• Have Functional English
• Hold private health insurance
• Have access to sufficient funds to support themselves in Australia
• Genuinely intend to stay temporarily in Australia for the intended purpose
• Meet health and character requirements

Sponsorship by an approved Temporary Activities Sponsor is required.

Occupational Trainees

This pathway requires a nomination by the sponsor to do one of the following activities in Australia:

• Training required to obtain registration, membership or a licence to work in Australia or home country
• Training in a gazetted occupation – in this case, the applicant must have worked full time in the occupation for at least 12 of the last 24 months
• Up to 6 months of practical experience, research or observation is required to obtain an overseas qualification
• Training supported by a government agency or the applicant’s home government

Occupational training would generally require at least 70% of the training to be on-the-job versus classroom training.

Professional Development

Requires you to be working overseas in a management or professional position. Training is primarily classroom training and would need to be in skills relevant to your position.

Application

The application must be lodged online. You can either be in Australia or overseas when lodging the application.

Family Members.

Family members (spouses and children) can be included in your application.

Conditions

The visa is generally valid for stay in Australia of 2 years. The visa is subject to condition 8102 which forbids work apart from the training specified in the visa application. You must also maintain your health insurance whilst in Australia.

In Brief, as stated in policy, Fraud within the Visa and Citizenship Programmes is a high risk for the Department. People may present bogus documents, conceal information or provide false or misleading information where they would otherwise fail to meet the criteria for a visa. They may commit fraud to facilitate people smuggling, human trafficking, drug trafficking or terrorist operations.

In order to manage the risks, appropriate mitigation strategies must be in place.

Public interest criterion (PIC) 4020 is intended to significantly increase the level of integrity in visa applications by providing a strong disincentive to those considering giving, or causing to be given, a bogus document or information that is false or misleading in a material particular. It also requires applicants to satisfy the delegate as to their identity.

PIC 4020 is one of the Public Interest Criteria in Sch 4 of the Migration Regulations 1994 (the Regulations). Where PIC 4020 is among the criteria for grant of a visa, unless the requirement to satisfy PIC 4020 is waived under PIC 4020(4), it must be met in order for the visa to be granted. Failure to satisfy PIC 4020 is grounds for visa refusal not for visa cancellation.

PIC 4020 contains two key areas:

1.Fraud relating to bogus documents and false or misleading information

2.Satisfaction with the applicant’s identity.

PIC 4020 enables refusal of a visa if the applicant provides a bogus document, or information that is false or misleading in a material particular in relation to the application for the visa.

As noted by Justice Buchanan in Trivedi when he held

For the reasons I have already given, it should be accepted that PIC 4020 is directed to information or documents which are purposely untrue.  It seems to me to be clear from the same analysis that the purpose of PIC 4020 was to render visa applicants ultimately responsible for the veracity of the information and documents supplied to support the application.  Although the limited terms of the waiver (and therefore any discretion to excuse non-compliance) make it apparent that innocent errors are not the focus of attention, it is equally clear that PIC 4020 is directed at the overall integrity of the visa system and as a bulwark against deception and fraud from any quarter associated with a visa applicant.  It is not inconsistent with a coherent public policy to make a visa applicant ultimately responsible for purposely untrue material provided with a visa application.  It would be an intolerable burden on the administration of the visa system to require that those assessing visa applications not only discover that information or documents are false in a material particular, but also that the visa applicant who provided them knew them to be so.  In many cases that would be impossible and would defeat the apparent intent of the provision.

It was against this backdrop that a client approached AR LAW Services – their 189 Skilled Visa had been refused due to the fact the case officer determined that the submitted work references where “bogus” documents.  The client had been badly assited and poorly advised by a migration agent who clearly did not have the required skill nor knowledge to manage such a visa application.

The incompetence of the Migration Agent is most telling and can be most clearly seen in the agents moronic and poorly drafted reply to the case offices “natural justice” letter. (This letter is a very important opportunity for visa applicants to “clarify” and hopefully sort out any integrity issue that may arise)

Given the migration agents borderline negligent reply to the case officer the visa was refused.

The client was desperate and understandably angry with the migration agent (and will probably sue) when he came to AR LAW Services. (The other issue was he filed his own AAT appeal consequently AR LAW Services had to do a great deal of remedial work to give the appeal any chance)

Following the securing of many original documents and sworn affidavits AR LAW Services made a detailed and voluminous submission to the Tribunal, where the basic construction of PIC 4020 and the relevant jurisprudence was contested.

The hearing was held recently at the Administrative Appeals Tribunal Perth and following a day of evidence AR LAW Services prevailed.

The applicant was found to have not been in breach of PIC 4020 and the visa application was remitted to the department for reconsideration.

That is, we won!

If you are a person holding an Australian visa you now will automatically fails the ‘character test’ if you have been sentenced to 12 months in prison for one or more offences. Conviction for the commission of a single, but more severe, criminal offence alone may be sufficient grounds for the Australian government to cancel your visa, or repeated convictions for less sever criminal offences can also lead to the cancellation of your visa. There are also various other considerations which the DIBP will look at to determine if it considers you to be of bad character and therefore, move to cancel your visa.

To apply to Regional Development Australia Northern Inland for Skilled Regional Sponsorship the applicant is expected to make a commitment as well as to make a genuine effort to satisfy 489 visa conditions in the region – full-time equivalent employment for at least 12 months and living in the regional area for at least 2 years.

The applicant is expected to make genuine attempts to find work in Northern Inland NSW. If an applicant has applied from within Australia, NSW Government expects the applicant to relocate to the region within 3 months of receiving the Visa Grant Notice.

Subclass 489 visas are subject to Condition 8549.  A person whose visa is subject to condition 8549 must live, work and study only in an area specified as a designated area of Australia.

When applying for a provisional points-tested skilled migration visa, applicants sign an undertaking that they understand and accept the conditions associated with the visa. However, under policy, it is consistent with the intention of the condition that a visa holder who continues to be employed in a specified regional area and continues to reside in a specified regional area might travel to an area outside a specified regional area for work or recreational purposes such as:

• for once-off business reasons
• a brief holiday or
• to undertake training for work.

The following occupations were removed from the RDA Northern Inland Occupation List on Thursday 11 October 2018:

• Registered Nurse (Aged Care) 254412
• Registered Nurse (Child & Family Health) 254413
• Registered Nurse (Community Health) 254414

• Registered Nurse (Medical Practice) 254421

The following occupations were removed from the RDA Northern Inland Occupation List on Friday 28 September 2018. Applications received before this time will be considered BUT they must be complete applications, with all requirements met or a negative outcome may result:

Whilst there is no set processing time for subclass 489 visas, NSW Government will endeavor to consider applications within 6 months of nomination lodgments.

Applying for a release letter:

A “Release Letter”, releasing a 489-visa holder from their obligation to their assigned region may not be granted without the visa holder showing that they have taken serious steps to relocate to or remain in this region, through seeking employment. Such a letter can provide peace-of-mind when a skilled migrant need to broaden their job search beyond their nominating region.

RDA Northern Inland has been informed that 489 visa holders do not need a “Release Letter” for their permanent 887 visa application.

887 Pathway

Subclass 489 may lead to permanent residency assuming all applicable criteria is met.  If the applicant’s objective is to obtain permanent residence, they will need to apply for a subclass 887 visa.

This is a permanent visa for people who have lived and worked in specified areas of regional Australia. Visa sub-class 489 recipients are eligible to apply for this.

The requirements include having:

• lived in a regional Australia/low population growth metropolitan area for at least two years if you were nominated by a state or territory government
• lived in a designated area of Australia for at least two years if you were sponsored by an eligible relative
• worked full time (usually at least 35 hours a week) in a specified regional area for at least a year while you held your eligible visa
• complied with the conditions attached to your eligible visa or your Bridging visa.

An applicant can meet the work requirement if they worked at least 35 hours a week in one full-time job or in two part-time jobs.  Prospect applicants can include any paid employment or self-employment, and they will need to be able to provide evidence of employment claims

1.            Processing Times

Home Affairs published latest processing times for subclass 482 visas.   Based on the October 2018 processing times frames, 75% of all 482 applications are processed in:

• 49 days – Short Term Stream
• 38 days – Medium Term Stream
• 22 days – Labour Agreement Stream
• 38 days – Sponsorship
• Nominations – 35 days

2.            457 Legacy Cases

Home Affairs is aware that a number of applicants with approved 457 nominations are currently awaiting outcome on their 457-visa application.  Current processing times for 457 visas is 13 to 15 months from lodgement date based on processing times published for October 2018.

3.            Bridging Visas

In the event where an applicant is required to obtain a Bridging Visa or vary conditions attached to their existing Bridging Visa, the following process should be followed:

• Bridging Visa, A or C with no work rights.  If an applicant wants to apply for a bridging visa A or C to allow to work on a Bridging Visa, an application should be lodged via ImmiAccount and ask to have conditions changed. If the bridging visa is linked to a TSS visa application, to be considered eligible for work rights, you will need to provide evidence of financial hardship.
• Applications for Bridging Visa B (BVB) to travel should also be made online via ImmiAccount.  Home Affairs advises applicants to apply for BVB no more than three months, and not less than two weeks, before the date on which proposed travel is scheduled. Generally, decisions on Bridging Visa B’s are assessed within 10 business days.  Urgent travel may be accommodated.

4.            Other administrative considerations

• Police checks –  If an applicant requires a letter to be able to obtain a penal check, please email the bio-data page of the passport with the subject line ‘Front end load – Penal Check Letter’.
• Condition 8547 – Email: a completed form (1445 Form) with the subject line ‘8547 waiver’.  Waivers are assessed within 10 business days of receiving the request
• Incorrect information provided on the application – any incorrect information should be corrected using immi account

5.            Unlawful Decisions

Home Affairs may be in the position to review a TSS/457 refusal in the following circumstances:

• the decision has not been appealed to the Administrative Appeals Tribunal (AAT)
• you have provided detailed evidence/reasoning to support your claim
• your query references the ‘refusal query code’ relevant to your particular case
