Been away so long I hardly knew the place! Trouble with RRV? (Resident Return Visa)

In this post I want to write about two (2) recent – well fairly recent – cases I won that had a similar set of facts. Both are tales of love and travel and how time files and just when you wish to come home to Australia the buggers stop you at the airport.

Both applicants had a similar story. They arrived in Australia long long ago – 20 years and 16 years – respectively. They both arrived on a permanent class visa, as members of a family, unit keen to start their life in Australia.

Both fell in love – not with each other I might add – shortly after arriving in Australia – one of the applicants a matter of hours.

Then each “ran” back off overseas – one to the US the other to the Japan.

Both approached me having attempted to secure a resident return visa.

Important cases

But both failed – one with the assistance of a dodgy migration agent the other with a fairly competent and well know large immigration law firm.

Both application look set to go to the AAT however AR LAW Services: Master Migration Lawyers were retained and we secured an extension of time and were able to clarify the law as to the correct interpretation and convince the decision maker to grant the visa – and they all lived happily ever after…
