As often happens I am retained by other law firms and migration agents to assist with difficult cases; like a solicitor briefs a barrister or a Silk (now KCs) lawyers and migration agents instruct me.
And that is what happen in this instance. In 2016 a solicitor from a family law firm reached out to me and asked if I could meet with their client and provide some advice. [The reason they approached me at that time was I had just won a significant refugee appeal case that turned on a women at risk argument]
The client we will call Katie (not her real name) who had arrived in Australia on a temporary visa with her family and looking forward to a new life, however tragedy struck and her father died.
The country and culture that Katie came from would be considered by some to be patriarchal. (honor killings – violence towards women – sexual assault of children)
As often with these cases a migration agent has been involved before they get to me and as often is the case those previous agents have not identified or argued the best or most suitable grounds.
Given Katies cloistered upbringing it took a great deal of time to build rapport and trust.
Once that trust was established, she confided in me and reveal a harrowing account of childhood rape and religious violence.
With the assistance of my team of health care and psychological therapist (I have been working with these professionals for over 15 years and they are the best) we were able to not only assist in drawing the required legal submissions but assist Katie in finding some closure.
Like the criminal cases I have been involved with in the past, the entire process is grueling for the client and this appeal was no different for Katie: a young woman who had lost her beloved father and was now trying to cope with a gross betrayal of trust, a betrayal that no 11 year old child should have to undergo.
The problem with the case was evidence – due to the fact it was an historic rape case – and there had never been a report of any kind or an investigation at the time. So contemporary evidence? – there was none, but for the word of an eleven year old girl.
After numerous written submission and several days before the tribunal with hours of expert evidence the Senior member reserved her decision.
Now remember we were first retained in 2016. I am happy to report that yesterday the AAT sent official word, we won the case!
And now Katie can commence her new life safe in Australia.
